By creating an account or using Happy Break, you agree to these Terms & Conditions and our Privacy Policy. If you don’t agree, please don’t use the app.
Your continued use of Happy Break after updates to these Terms or our Privacy Policy constitutes acceptance of those changes.
2. Who Can Use Happy Break
Happy Break is designed for children ages 0–6 and must be set up and managed by a parent or legal guardian. You must be at least 18 years old to create and manage a parent account. Parents are responsible for configuring and supervising their child’s use of the app.
3. Description of Service
Happy Break helps parents create calmer screen-time transitions for children. The app works with YouTube and local videos and uses the Happy Break Engine to gradually reduce visual and audio stimulation through features such as grayscale, brightness reduction, volume reduction, optional blur, soothing sounds, and age-appropriate transition activities. Happy Break also provides parents with session summaries and usage insights. Happy Break is designed to support parents during screen-time transitions and is not a parental control, content-filtering, medical, therapeutic, or educational service.
4. Child Safety & Parental Supervision
Happy Break is intended to assist parents and legal guardians with screen-time transitions. It does not replace active parental supervision, parental judgment, or professional advice. Parents remain responsible for deciding whether the app, selected content, session duration, sound levels, brightness levels, and transition settings are suitable for their child.
5. Children’s Privacy & COPPA Compliance
Happy Break is designed to be used by parents or legal guardians on behalf of children ages 0–6. We are committed to complying with applicable children’s privacy laws, including the Children’s Online Privacy Protection Act (COPPA) in the United States and similar laws where applicable.
Parents are responsible for creating and managing child profiles. Happy Break does not knowingly collect personal information directly from children without appropriate parental authorization. Information is collected and processed in accordance with our Privacy Policy.
Parents may review, update, or request deletion of their account information as described in our Privacy Policy.
6. Parent Consent
By creating a Happy Break account and using the service on behalf of a child, you confirm that:
- You are the child’s parent or legal guardian.
- You consent to the collection and processing of your information as described in our Privacy Policy.
- You are authorized to configure and manage your child’s use of Happy Break.
- You accept responsibility for supervising your child’s use of the service.
7. Subscriptions & Billing
Happy Break offers a Free plan and a Premium subscription. Premium subscriptions are billed through the Apple App Store or Google Play and automatically renew unless canceled before the renewal date. Eligible users may receive a 7-day free trial. A valid payment method is required to start the trial, and the subscription will automatically begin when the trial ends unless canceled beforehand. You can manage or cancel your subscription through your Apple App Store or Google Play account. Subscription pricing, features, and availability may vary by region.
8. Your Responsibilities
You are responsible for selecting age-appropriate content, configuring session settings suitable for your child, supervising your child’s use of the app, maintaining the confidentiality of your account credentials, and using Happy Break in compliance with applicable law.
9. Acceptable Use
You may not disrupt the service, reverse-engineer or copy the app, bypass subscription or access controls, gain unauthorized access to accounts or systems, misuse remote-control features, introduce malicious code, use the app for unlawful or harmful purposes, or interfere with another person’s use of the service.
10. Intellectual Property
Happy Break, the Happy Break Engine, Panda mascot, logos, animations, graphics, audio, software, user interface, trademarks, and all related content and technology are owned by Happy Break or its licensors and protected by applicable intellectual-property laws. These Terms grant only a limited, personal, non-exclusive, non-transferable, revocable right to use the app as intended.
11. YouTube & Third-Party Content
Happy Break allows parents to access YouTube videos and local videos as part of a screen-time session. Happy Break does not own, control, review, or endorse YouTube videos or other third-party content. Parents are responsible for selecting content appropriate for their child. Availability, playback, advertisements, recommendations, and other YouTube functionality are controlled by YouTube and may change or become unavailable. Use of YouTube content is also subject to YouTube’s applicable terms and policies. Happy Break is not affiliated with or endorsed by Google or YouTube.
12. Disclaimer of Warranties
Happy Break is provided “as is” and “as available.” We do not guarantee uninterrupted, secure, or error-free operation. Happy Break is not a medical, psychological, therapeutic, behavioral, or educational service and should not replace professional advice. Every child responds differently, and we do not guarantee specific outcomes, including reduced tantrums or improved screen-time habits.
13. Limitation of Liability
To the fullest extent permitted by law, Happy Break and its team are not liable for indirect, incidental, or consequential damages arising from your use of the service.
Happy Break is not responsible for interruptions, unavailable content, playback issues, or other limitations caused by YouTube, third-party services, internet connectivity, device compatibility, operating-system restrictions, app-store policies, or circumstances beyond our reasonable control.
14. Termination
You may stop using Happy Break or cancel your subscription at any time. Canceling a subscription does not automatically delete your account. You may request account deletion as described in our Privacy Policy. We may suspend or terminate access for violations of these Terms, fraud, abuse, security risks, unlawful conduct, or misuse of the service.
15. Changes to These Terms
We may update these Terms from time to time. We’ll post the updated version here with a new “last updated” date, and will notify you of material changes by email.
Where required, we may also provide notice within the app. Your continued use of Happy Break after the revised Terms become effective constitutes acceptance of the updated Terms.
16. Governing Law
These Terms are governed by the laws of the jurisdiction where the Happy Break contracting entity is established, without regard to conflict-of-law principles.
17. Events Beyond Our Control
Happy Break will not be responsible for delays, interruptions, or failures caused by events beyond its reasonable control, including internet outages, app-store interruptions, cloud-service failures, third-party platform changes, natural disasters, government actions, device or operating-system restrictions, or failures of telecommunications providers.
